Apprehending arrest in connection with C.R. No. 294/2019 registered with the Sanjay Nagar Police Station, Sangli for the offences punishable under Sections 420, 468, 471, 504, 506 read with Section 34 of the Indian Penal Code, the applicant is seeking pre-arrest bail.

The complaint, prima-facie, discloses complicity of the applicant in the subject crime. It is alleged that, one Riyaz Kurane (co-accused) had persuaded the complainant and similar affected persons to pay huge amount of money for securing job in the para-military forces. The complainant and others had reported to Calcutta for medical examination, a pre-test before the employment in para-military forces at the instance of Riyaz Kurne (co-accused). Complaint shows, the applicant represented Riyaz Kurne and on his behalf had accompanied the complainant and similar affected persons at Calcutta for their medical examination which turned out to be bogus examination. Though, it is alleged that, Rs.3,50,000/- were paid to Riyaz Kurane, (coaccused) for securing employment, the complaint prima-facie, discloses applicant s participation '

in the alleged crime. Not only this, the appointment letters allegedly issued by the paramilitary forces were also allegedly forged. In view of the facts, this is not a fit case to extend pre-arrest bail to the applicant. The application is therefore rejected.

It is made clear that observations made hereinabove shall be construed as expression of opinion only for the purpose of refusal to grant bail and the same shall not in any way influence the trial in other proceedings.
