The petitioner is original defendant No.1, is challenging the judgment and orders passed by the Courts below restraining the petitioner from disturbing the respondents while carrying out the construction over the suit property. The Trial Court has passed an injunction order on 6th November 2020, since then the order of injunction is in force. Hence, at this stage, no interference is called for, the writ petition stands dismissed.

However, it is made clear that the observations made in the impugned order shall not be influenced the Trial Court while deciding the suit on merits.

Considering the subject matter of the suit, hearing is expedited.
