Heard learned counsel for the applicant and learned APP for the State.

This is an application for pre-arrest bail in respect of the offence punishable under Sections 354 and 506 of the Indian Penal Code, 1860 in connection with C.R. No.593 of 2022 dated 24/10/2022 registered with MIDC Police Station, District Solapur.

The complainant is married. It is alleged that she had come at her parental home during diwali. The applicant was 1/4

known to the family. On 24/10/2022 the applicant came outside the house and called the complainant's mother as he wanted to talk to her. The complainant's mother asked the applicant as why he had come and his presence is coming in the way of complainant's marriage. When the complainant went outside her home, the present applicant caught hold of her hand and insisted that she come with him for cohabitation. The applicant is 23 years of age. The accusations do not justify the conduct of the applicant. In my opinion considering the nature of accusations, the applicant will face the consequences of the trial. Some stringent conditions need to be imposed. His custodial interrogation is not required. The applicant must co-operate with the investigation.

Learned counsel for the applicant on instructions makes a statement that he will not enter the vicinity of the complainant's residence and will not try and establish any contact with her during the pendency of the trial. Statement is accepted.

Hence, the following order :- 2/4

O R D E R

(a) Application is allowed.

(b) In the event of arrest in connection with C.R. No.593 of 2022 dated 24/10/2022 registered with MIDC Police Station, District Solapur, the applicantRaju Dashrath Chinta shall be released on bail on furnishing P.R. Bond to the extent of Rs.15,000/- with one or more sureties in the like amount.

(c) The applicant shall report to the Investigating Officer of the concerned police station on 08/03/2023 and 09/03/2023 between 11.00 a.m. and 1.00 p.m. and thereafter as and when called.

(d) The applicant to co-operate with the Investigating Officer.

(e) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing the facts to Court or any Police Officer and shall not tamper with evidence.

(f) The applicant shall furnish the details of his residential address and phone number to the investigating officer.
