IN THE HIGH COURT OF JUDICATURE AT BOMBAY
CRIMINAL APPELLATE JURISDICTION CRIMINAL APPLICATION NO. 108 OF 2014 IN CRIMINAL WRIT PETITION NO.1691 OF 2013 Ajit Chandrakanth Rane ...Applicant
Versus
The State of Maharashtra
...Respondent
...
Ms Najma Shaikh, Advocate appointed for the Applicant. Smt. V.R. Bhonsale for the Respondent -State. CORAM: SMT. V.K. TAHILRAMANI & SMT. ANUJA PRABHUDESSAI, JJ DATED: 13th APRIL, 2016 PC:- This application has been preferred by the Applicant in Writ Petition No.1691 of 2013, which was preferred by the Applicant. The prayer of the Applicant /Petitioner is for furlough. 2.
The Writ Petition No.1691 of 2013 was filed by Advocate, Mr. Hitesh Shah. On account of the fact that the said Advocate remained absent on 26.11.2013 as well as on earlier occasion i.e. 12.11.2013, the Writ Petition 1691 of 2013 came to be dismissed for default on 26.11.2013 as none appeared for the Petitioner. In this view of the matter this application does not Megha 1/2
6_appw_108_2014 in wp_1691_13 survive as the writ petition itself has been disposed of on 26.11.2013.
3.
Moreover it is seen that Writ Petition No.1681 of 2013 was filed on 29.4.2013. At that time only application of the Petitioner for furlough was rejected. However, thereafter the appeal preferred by the Applicant /Petitioner against the order of rejection came to be dismissed by the IG (Prison) on 4.5.2013. It would be open to the Petitioner to challenge the said order. 4.
The application is disposed of in above terms. 5.
Office to communicate this order to the Applicant, who is at present in Nashik Road Central Prison.
