IN THE HIGH COURT OF JUDICATURE AT BOMBAY

CIVIL APPELLATE JURISDICTION WRIT PETITION NO.3915 OF 2014 Shri. Kurukali Gramin Bigar Sheti Sahakari Patsanstha Maryadit and another .. Petitioners

Versus

Divisional Joint Registrar and others .. Respondents Shri. Chetan G. Patil, for the Petitioners.

Shri. S. D. Rayrikar, AGP for the Respondent No.1. CORAM : R.M. SAVANT, J.

DATE : 08th MAY, 2015 P.C.

1.

A Praecipe has been filed for speaking to the minutes of the order dated 27th April, 2015. In paragraph 3 on page No.4 in the last line through inadvertence it has been stated to the following effect : "if the amount is not deposited the benefit of this order would not enure to the Respondent Nos.2 to 4 and resultantly, the Petition would be deemed to be dismissed as also the Revision Application."

Since the Petition has been filed by the credit society, the words "the Petition would be deemed to be dismissed" would have to be deleted and the said lines would have to be rephrased as follows: "if the amount is not deposited the benefit of this order would not enure to the Respondent Nos.2 to 4 and BGP.

WP-3915-14.doc 08.05.2015 resultantly, Revision Application would stand dismissed." Hence, the three lines i.e. from line No.8 from the bottom to line No.6 would read thus : "If the amount is not deposited the benefit of this order would not enure to the Respondent Nos.2 to 4 and resultantly, the Revision Application would stand dismissed."

The same to be included in the order dated 27th April, 2015. The parties to be furnished the corrected copy of the order, if applied for. The praecipe for speaking to the minutes of the order is disposed of. [R.M. SAVANT, J] BGP.
