This is an application for suspension of sentence and for grant of bail, pending the hearing and final disposal of the aforesaid revision application. The applicant, by the judgment and order dated 2 August 2018, passed by the learned Judicial Magistrate First Class, Kolhapur, in Criminal Case No.2126 of 2016, has been convicted and sentenced to suffer rigorous imprisonment for six months and to pay compensation of Rs.2Lakhs to the complainant/respondent No.1, and in default to further undergo simple imprisonment for six months. 2.

In Cr.Appeal bearing No.152 of 2018, filed by the applicant, the learned Additional Sessions Judge, Kolhapur, confirmed the conviction in the judgment and order dated 2 August 2018, passed by the learned Judicial Magistrate First Class, Kolhapur.

The learned Counsel for the parties jointly drew the attention of this Court to the Order dated 24 February 2023, passed by this Court, submitting that the substantive sentence was suspended untill the next date of hearing, subject to the deposit of Rs.2 Lakhs in the Court learned Judicial Magistrate First Class, Kolhapur.

The learned Counsel for the applicant submits that the applicant has already deposited the said amount as directed by this Court within the stipulated period.

Considering the nature of accusations, pending the hearing and disposal of the criminal revision application, the applicant's substantive sentence is suspended and he is enlarged on bail on executing personal bond of Rs.15,000/- with one or more sureties in the like amount.
