In this public interest litigation (PIL), the petitioner has sought a direction to the respondents to recover an amount of Rs.6,10,178/- (Rupees Six Lakh Ten Thousand One Hundred Seventy Eight only) from respondent no. 4 on the basis of the report submitted by respondent no. 3 dated 20th September 2004.

Learned AGP, on instructions, submits that during the pendency of the writ petition, the amount in question has been recovered and the issue involved in this PIL has been rendered infructuous. In support of her submission, our attention has

224-PIL.39.2005.doc been invited to paras 2 and 3 of the affidavit in rejoinder filed on behalf of the petitioner himself.

In view of the aforesaid submission, the issue involved in the PIL does not survive for consideration. Accordingly, the PIL is dismissed as infructuous.
