The petitioner no.6 has been offered appointment during the pendency of this writ petition. However, the other petitioners' claims for compassionate appointment are still pending.

Ms. Salunkhe, learned AGP appearing for the State, raises preliminary objection to the maintainability of the writ petition on the ground that the remedy of the petitioners 1 to 5 lies in an appropriate proceeding before the Maharashtra Administrative Tribunal.

Confronted with such an objection, Mr. Tajane, learned advocate for the petitioners, seeks leave to withdraw the writ petition with liberty to approach the Maharashtra Administrative Tribunal.

Leave, as prayed for, is granted. The writ petition stands dismissed as withdrawn with liberty as prayed for. No costs.
