By this application, the applicant-State seeks leave to file appeal against the judgment of the Additional Sessions Judge, Karad dated 30/10/2014 in Sessions Case No. 53 of 2009 acquitting the respondents for offence punishable under Sections 302 , 201 read with Section 34 of the IPC.

We have heard the learned APP and with whose assistance we have perused the findings recorded by the trial court. Upon such perusal, in our opinion, this is a fit case for granting leave. 4.

We accordingly allow this application and grant leave as prayed for.

Appeal filed by the State stands admitted. Action under Section 390 of the Cr. P .C. to be taken by the trial court by issuing bailable warrant for Rs.25,000/- each against the respondents. (DR. SHALINI PHANSALKAR-JOSHI,J.) (P. V. HARDAS,J.)
