Heard learned counsel for the applicant and learned APP for the State.

This is an application for pre-arrest bail by the applicant in connection with First Information Report (FIR) No.618 of 2022 dated 19/11/2022, registered with MIDC Police Station, Solapur, under sections 354, 354-A and 354D of the Indian Penal Code, 1860. 3.
The complainant is a married lady of 33 years of age alleges in the FIR that the applicant is her maternal cousin. Recently, the applicant started residing somewhere near her residence. He contacted the complainant on his mobile phone. Thereafter, the applicant proposed to the 1/3
complainant. On the pretext that the complainant could receive some financial help for the education of her child through a scheme, the applicant called the complainant to his room with some documents. The complainant went on 12/11/2022 along with her son. The applicant sent the complainant's son to get some snacks. The applicant told the complainant that she should stay with him instead of her husband who is a drunkard and that he would take care of her and her child. The complainant left the room. She did not report this incident. It is then alleged that on 18/11/2022 when the complainant was walking on the road alone at 9.00 p.m., the applicant followed her and caught hold of her hand and asked her to come to his room. The FIR was registered on the next day. The accusations are no doubt serious in nature.

However, taking an overall view of the matter, custodial interrogation of the applicant is not needed as the complainant's version is already on record. The applicant will face the consequences of the trial. The applicant must fully cooperate with the investigation. Learned counsel for the applicant submitted, on instructions, that the applicant is willing to reside outside the area of the MIDC police station and that he will not establish any contact with the complainant. The statement is accepted. Hence, the 2/3
following order.
ORDER
(a) In the event of arrest in connection with FIR No.618 of 2022, registered with MIDC Police Station, Solapur, the applicant- Umesh Suresh Chaudhari shall be released on bail on furnishing P.R. Bond to the extent of Rs.15,000/- with one or more sureties in the like amount;
(b) The applicant shall report to the Investigating Officer on 08/03/2023 and 09/03/2023 between 11.00 am and 01.00 pm and thereafter, as and when called;
(c) The applicant to co-operate with the Investigating Officer;
(d) Except for the purpose of reporting to Investigating Officer, the applicant shall not enter the area of MIDC police station till the conclusion of trial;
(e) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing the facts to Court or any Police Officer and shall not tamper with evidence.

The application stands disposed of.
