rpa 2/2 4-wp-2991-19.doc It is pointed out that the Respondent No.5 has already paid Rs.3,92,00,000/- to the Petitioner Bank. Learned Counsel for the Petitioner Bank submits that the outstanding amount is over and above the amount of Rs.3,92,00,000/-. He states on instructions from Mr.Arvind Kulkarni, Deputy General Manager and Mr.Jaydeep Patil, Chief Manager who are present in Court that the Petitioner Bank is willing to accept a further sum of Rs.8,00,000/- in full and final settlement of the Petitioner Bank's dues. Learned Senior Counsel for Respondent No.5 states that a cheque in the sum of Rs.8,00,000/-, shall be handed over to the learned Counsel for the Petitioner Bank during the course of the day. We accept the statements.

Upon payment of Rs.8,00,000/- as stated above, the Petitioner Bank shall issue No Dues Certificate and handover the original title deeds to Respondent No.5 within a period of two weeks from today.
