At the outset, learned A.P.P raises a preliminary objection. She submits that the applicant has filed the aforesaid application seeking modification of the condition imposed by the learned Sessions Judge vide order dated 16th January, 2016, being condition No. 2(i), which is on page

17. She submits that the applicant ought to have filed an application seeking modification before the same Court.

In view of the said preliminary objection, learned Counsel seeks leave to withdraw this application with liberty to file an appropriate application seeking modification of the said condition imposed by the learned Sessions Judge vide order dated 16th January, 2016, being condition No. 2(i).

The application is accordingly disposed of as withdrawn with liberty as prayed. If an application as aforesaid is filed, the learned Judge to decide the same as expeditiously as possible. 4.
