This Application is moved for restoration of First Appeal after one year and 215 days. The learned counsel for the applicant submitted that the Appeal is admitted on 4th July, 2011 and by the order of this Court dated 4th July, 2011, the Appeal was dismissed for non-compliance of filing of paper book within one year without referring to the Court. 2.

Today, the learned counsel for the applicant submitted that the appellant is ready to file paper book, however, inadvertently the order of this Court dated 4th July, 2011 was not complied with. He prays for restoration of First Appeal.

In view of the submissions of learned counsel for the applicant and 1 / 2

902.CAF2688_2014.doc for the reasons mentioned in the Application, delay is condoned. The order dated 4th July, 2011 is recalled and First Appeal is restored to its original file. The paper book is to be filed till 29th February, 2016. If the paper book is not filed within the stipulated time, Appeal will be dismissed without referring to the Court.
