As far as said issue is concerned, it is always open to the Petitioner to carry out private measurement and if so found, move with a prayer for removal of encroachment by amending the Plaint. Keeping such option open to the Petitioner, prayer made by the Petitioner for withdrawal of the Petition is granted.
