Mr.Sarda, learned counsel for the intervener, states that the

2/2 26-ba.439.2016.doc charge-sheet in the said case has been filed yesterday. In view of the said statement, learned counsel for the applicant does not press this Application and seeks leave to withdraw the same with liberty to file an appropriate application, after filing of the charge-sheet. 2.

Application is accordingly disposed of as withdrawn with liberty as prayed.

It is made clear, that this Court has not gone into the merits of the said matter and if an application, after filing of the charge sheet is filed, the same shall be considered on its own merits, uninfluenced by the withdrawal of the aforesaid application.

In view of the aforesaid, the Intervention Application being Criminal Application No.251 of 2016 does not survive and the same is also disposed of.
