Learned counsel for the applicant submitted that the trial has commenced. It is submitted that the victim is not coming forward to depose. Learned counsel for the applicant on instructions seeks leave to withdraw the application with liberty to file a fresh application after six months, if the trial does not progress substantially or after the evidence of the prosecutrix is recorded whichever is earlier.
