Heard learned counsel for the applicant and learned APP for the State.

This is an application for suspension of sentence and bail for the offence punishable under Section 304-A of the Indian Penal Code, 1860. The applicant is convicted by the trial Court and sentenced to suffer rigorous imprisonment for one year and to pay fine of Rs.6,000/-. The fine amount has been paid. The Criminal Revision Application has been admitted. The applicant was on bail during the trial. There is nothing on record to indicate that the applicant has misused 1/3

his liberty while on bail. Considering the short sentence and as the Criminal Revision Application is not likely to be heard any time soon in near future, despite the opposition of learned APP, I am inclined to suspend the sentence. Hence, the following order :-

O R D E R

(a) The sentence imposed by the trial Court and as confirmed by the Appellate Court is suspended. (b) The applicant-Pravin Sangram Togre shall be released on bail on his furnishing P.R. Bond of Rs.15,000/- with one or more sureties in the like amount.

(c) The applicant is permitted to furnish cash bail surety in the sum of Rs.15,000/- for a period of 6 weeks in lieu of surety.

(d) The applicant shall report to the trial Court once in a year, i.e. first Monday of the concerned month, between 11.00 a.m. and 1.00 p.m. commencing April 2024.

(e) On being released on bail, the applicant shall furnish his contact number and residential address to the Trial Court as well as the Investigating Officer and shall keep them updated, in case there is any change. 2/3

The interim application is disposed of in the above terms.
