This is an application for leave to file appeal, preferred by the State, challenging the acquittal of the respondents in the matter of offences punishable under sections 324,323,504 and 506 read with section 34 of Indian Penal Code. Offence punishable under section 324 of Indian Penal Code is cognizable and non­bailable and as such in view of provisions of section 378(1)(a), the appeal challenging the acquittal for said offence is required to be taken before Sessions Court as the order of acquittal passed by the Judicial Magistrate, First Class, Wai, Satara.
