Heard learned Counsel for the parties.

This Application is made by the defendant for fixing early date of hearing of Second Appeal no. 509 of 2004 on the ground that applicant is Senior Citizen.

The learned counsel for the applicant submits that applicant undertakes to file private paper book within eight weeks from today. The statement is accepted.

Considering the submissions made by the learned counsel for the Applicant, the averments 1/3

made in the Application and as the applicant is senior citizen, I am satisfied that the Applicant has made out a case for allowing the present Civil Application.

Hence, the following order:

a) Applicant is permitted to file private paper book within eight weeks from today.

b) If private paper book is filed within stipulated time as stated hereinabove, hearing of Second Appeal no. 509 of 2004 is expedited in the category of Senior Citizen.

c) Civil application stands disposed off accordingly.
