Heard Mr. Bhavake, learned counsel for the applicant. He submitted that on 12.9.2014 this Court issued notice for final disposal, returnable after four weeks.
Ad-interim order in terms of prayer clause (c) was granted. Despite service, the respondent did not enter appearance. The Application was, thereafter, dismissed in default on 10.3.2015. For the reasons stated in the Application and in particular paragraph 4, he submitted that the
2/2 CAO/62 /2015 application deserves to be restored by recalling the order dated 10.3.2015.

In view thereof and for the reasons stated in the Application, Civil Application is allowed in terms of prayers clause (b) and (c), with no order as to costs. Misc.
Civil Application No.164 of 2014 is restored to the file of this Court.
