Mr. Tajne, learned Advocate appearing for petitioner, fairly concedes that in view of law laid down by Court in case of Bhau Krishna Shinde (deceased) through L.Rs. Rakhamabai Bhau Shinde & Ors. v/s. Vastala Bhau Dhamale & Ors., reported in 2000 (1) Mh.L.J. 55, and Machindra s/o Santaram Kutwad v/s. Sharad s/o Khanderao Survase & Ors., reported in 2012 (6) Mh.L.J., thirdparty application cannot be considered in reference under Section 18 of Land Acquisition Act.

In that view of matter, he seeks permission to withdraw ADN
