This application for anticipatory bail is moved by the applicant/accused as he apprehends arrest in C.R. No.200 of 2013 registered at Satara taluka police station, Satara under section 395 of the Indian Penal Code. It is to be noted that this application was admitted on 20.3.2015. At that time, interim protection was granted to the present applicant/accused and the Investigating Officer was to remain present. However, today, the Investigating Officer is not present. 2.
On perusal of the FIR, it is found that it is a case where the complainant was robbed of Rs.5,000/- when he was running an eatery. My attention is drawn by the learned Counsel for the applicant to the order of this Court dated 24.12.2013 in Anticipatory Bail Application 1334 of 2013. 1 / 2
aba.422.2015_5.doc In the said order, it is observed that the complainant had filed an affidavit in this Court and the said affidavit was relied by this Court while passing the said order granting anticipatory bail to the co-accused. In the said affidavit, the complainant has stated that the amount of Rs.5,000/-, which was allegedly stolen, was found in the courtyard of the said eatery on the next date and he had no objection to grant pre-arrest bail in favour of the co-accused.

In view of this and as there is no assistance of the Investigating Officer today, I pass the same order in this matter. Accordingly, the application is allowed as under:
i) In the event of arrest, the applicant/accused shall be released on bail upon furnishing P.R. Bond in the sum of Rs.15,000/-, with one or two sureties in the like amount;
ii) The applicant shall not tamper with the evidence; iii) The applicant shall not indulge into any kind of offence while on bail; iv) The applicant shall cooperate with the Investigating Officer and attend the concerned police station as and when called. (MRS.MRIDULA BHATKAR, J.) 2 / 2
