Heard learned Counsel for the parties. The writ petition is disposed of, by consent of both Counsel, in terms of the following order: (I)The impugned order of the Industrial Court dated 7 January 2015 is set aside.

(II)The Petitioner shall pay to the Respondent 50 months' wages based on his last drawn salary within a period of four weeks from today. This payment shall be accepted by the Respondent in full and final settlement of his claim arising out of BIR No.28/1990. (III)This order shall not prejudice the Respondent's claim for retirement benefits, if permissible under law. (IV)No order as to costs.
