After arguing the matter for some length, learned Counsel appearing for the Petitioner seeks leave to withdraw the petition with liberty to the Petitioner to file an appropriate application in pending Civil Suit, so as to challenge the impugned resolution dated 10 November 2014 and confirmation and approval by the Collector vide his order dated 29 May 2015.

With the aforesaid liberty, the petition is allowed to be withdrawn. Needless to say, if such application is filed by the Petitioner it will be open for the Civil Court to consider and decide the same in accordance
