It is pointed out by learned counsel for the petitioner that by order dated 18th April, 2022 passed in Writ Petition No.2342 of 2020, which is at page No. 33 of the paper book, the following directions came to be issued in paragraph 8, which reads thus :- "8.
In view of the aforesaid, the Writ Petition is disposed of by directing the Respondent Nos.5 and 6 to re-submit the proposal seeking release of pensionary beneits in favour of the Petitioner. If such proposal accordingly submitted, the 1 of
Education Oicer (Secondary) shall take a decision of the same in the light of the observations made herein above, within a period of six weeks from the date of receipt of such proposal. The proposal be considered in accordance with law and the decision be taken accordingly and communicated to the Petitioner."

Learned counsel for the petitioner submitted that the Education Oicer has complied with irst clause of the order dated 18th April 2022. However, the oice of the Indian Audit & Accounts Department by communication dated 18th November 2022 addressed to the Education Oicer (Secondary), School, Zilla Parishad, Kolhapur has informed that the oice was unable to process the pension case for the following reasons given in paragraph 1, which reads thus :- "1.
Smt. R.R. Mane is appointed as part time teacher from 16/10/2000 to 03/01/2007 and full time w.e.f. 04/01/2007 till 31/05/2018 till her retirement on superannuation. In this connection your attention is invited to letter dated 16/02/2022 from Addl. Chief Secretary, Secondary Education Department (copy enclosed) and you ae requested to obtain sanction from the Administrative Department at Mantralay as per Court order."

The pension papers, therefore, were returned for want of compliance with a request to resubmit the same duly complied with so as to enable the oice to inalize the pension case. 4.
It is the contention of the learned counsel for the petitioner that the Education Oicer has failed to comply with the directions in terms 2 of
of communication dated 18th November 2022.

Heard learned AGP for the respondents. It is submitted that there is no deliberate and willful breach and disobedience of the directions passed in the order 18th April 2022. We ind substance in the contention of the learned AGP.

In the present facts, the contempt petition can be disposed of by directing the Education Oicer (Secondary) to comply with the requirements in terms of the communication dated 18th November 2022, which is at page No. 64 of the paper book, within a period of 8 weeks from today. After the compliance is efected, in terms of the communication dated 18th November 2022, the Indian Audit & Accounts Department shall proceed to comply with the remaining part of the order expeditiously and in any case within 4 weeks therefrom. 7.
It is made clear that if the Education Oicer (Secondary) fails to comply with the order within the extended period of 8 weeks from the date of communication of this order, in such case, this Court may take a serious view.

The Contempt Petition is disposed of.

The petitioner to place a copy of the order on the record of Education Oicer (Secondary). In addition, learned AGP to inform the Education Oicer as regards passing of this order to the Education Oicer (Secondary).
