1] This application is filed seeking condonation of delay in preferring this Application and for setting aside the abatement order in bringing the legal heirs of respondent No.2 on record, who has died during pendency of the appeal.

2] As per office remark the legal heirs are duly served, none of them have appeared. In view, thereof, application is allowed. The delay is condoned. The order of abatement is set aside. The applicant to carry out necessary amendment within two weeks from the date of this order.
