Heard learned Counsel for the applicants and the learned A.P.P. 2.
By this application, the applicants seek pre-arrest bail in connection with C.R. No. 19 of 2016 registered with the Rahimatpur Police Station, for the alleged offences punishable under Sections 306, 323, 504, 506 r/w 34 of the Indian Penal Code and under Sections 11(4) and 12 of the Protection of Children from Sexual Offences Act, and under Section 3(1)(4)(s) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.

The Complainant is the mother of the deceased. She has alleged that co-accused Prashant Rokade was stalking her daughter and had made life miserable for her, as a result of which she could not attend college. She has set out the incidents in the complaint. She has alleged that the present Applicants would accompany co-accused Prashant Rokade and stand outside their house.

Learned APP has produced the statements of Harshada Gaikwad and Trishala Gaikwad, the sisters of the deceased and Angad Gaikwad, the neighbor of the deceased and other statements. He submitted that the said statements show that the present applicants were also present with Prashant Rokade and that they would accompany Prashant Rokade on a motorcycle and would trouble the deceased. 5.
Considering the role of the applicants and the fact that the allegations are mainly as against Prashant Rokade, the applicants are granted anticipatory bail on the following terms and conditions :
ORDER
(i) In the event of the arrest, the applicants be enlarged on bail on
3/4 furnishing P.R. Bond in the sum of Rs.25,000/- each with one or two sureties in the like amount ;
(ii) The applicants shall attend the concerned Police Station, on the first Sunday of every month between 10:00 a.m. to 11:00 a.m., till the conclusion of the trial;
(iii) The applicants shall not tamper or attempt to influence or contact the witnesses or any person concerned with the case; (iv) The applicants shall not enter the jurisdiction of Rahimatpur Police Station, for a period of 3 months from today, except for the purpose of attending the police station as per clause (ii) hereinabove; (v) The applicants shall inform their latest place of residence and mobile contact number immediately and/or change of residence or mobile details, if any, from time to time to the Court seized of the matter and to the Investigating Officer of the concerned Police Station.

The Application is allowed in the aforesaid terms and is accordingly disposed of.

It is made clear that the observations made herein are prima facie and are confined to this application and the learned Judge to decide the case on its own merits, uninfluenced by the observations made herein. 8.
