The Trial Court by the impugned order has rejected the application under Section 10 of the Code of Civil Procedure, 1908. 2.

Undisputedly, one suit is under the provisions of Maharashtra Rent Control Act; however, the second suit is before the Civil Court. Hence, the subject matter of both the suits and the nature of jurisdiction exercised by both the Courts below are different. Therefore, no interference is called for. The writ petition stands dismissed. No costs.
