The only grievance of the petitioner is that he had preferred an application before the Trial Court vide Exhibit­46 for referring the documents to the handwriting expert for his opinion. The said application was preferred on 27th November 2012. It is submitted that the Trial Court has not decided the said application. The say of the accused was called on 27th November 2012 itself, but thereafter no decision is delivered on the said application. It is submitted that the petitioner is 76 years of old person. It is, therefore, prayed that directions may be issued to the Trial Court to dispose off the said application preferred by the petitioner vide Exhibit­46. 2.

In the circumstances and more particularly considering the fact that application below Exhibit­46 is pending since last about five years in the Trial Court, it would be appropriate to direct the Trial Court to decide the said application expeditiously. Accordingly the Trial Court is directed to decide application vide Exhibit­46 filed by
