The delay of 286 days in moving the interim application for bringing legal heirs on record stands condoned. The interim application stands allowed in terms of prayer clauses (a), (b) & (c). Appropriate amendment to be carried out within four weeks from today.

This interim application is taken out for adding new party as petitioner no. 3 in WP/4513/2013. The addition is sought based on the relationship of the applicant with the petitioner no. 1 who happens to be her husband.

The fact remains that the applicant was not the party in any of the proceedings decided before the authority below. That being so the interim application cannot be granted. As such, stands rejected.
