Heard Mr. Suraj N. Naik, learned counsel appearing for the Applicant.

Mr. Suraj N. Naik, learned counsel states that, the Applicant is not in a position to pay the cost. He states that the Applicant is suffering from severe fnancial constraints. In the meanwhile, the Applicant suffered from serious illness and met with serious accident and required to be admitted in the hospital. Therefore, the Second Appeal No.806 of 2011 is restored to fle by awarding cost of Rs.500/- to be paid by the

31-IA-30609-2022.doc Applicant in the offce of Maharashtra State Legal Services Authority within a period of three weeks from today. 3.

In view of the above direction, order dated 13th October, 2015 passed by this Court in Second Appeal No.806 of 11 and order dated 21st April, 2017 passed by this Court in Civil Application No. 1033 of 2016 in Second Appeal No.806 of 2011 to the extent of awarding cost are recalled. 4.
