On 07/09/2018 the matter was adjourned to enable the Registry to find out the correct bench for hearing the controversy. 3.
Today counsel for the respondent no. 1 and learned AGP are opposing any adjournment. Nobody appears for the petitioners. 4.
Learned counsel invited our attention to the order dated 06/07/2007 in Writ Petition No.7601 of 2006. The said order shows that the learned Single Judge then held that the question about the status of subject land was a finding of fact which was nilegaonkar 1/2
21-WP-4037.2017.odt already decided and the land was found to be always Government Fallow land. It appears that the petitioners claim that after this order, they came across some documents which further their claim that the said land happens to be Mahar Watan Land. According to the respondents, those documents do not support the petitioners but show that the earlier conclusion by this Court is correct. We in this situation, dismiss writ petition for want of prosecution.
