CIVIL APPELLATE JURISDICTION Digitally signed by BALAJI GOVINDRAO PANCHAL Date:
2022.04.05 16:40:45 +0530 BALAJI GOVINDRAO PANCHAL WRIT PETITION NO.4037 OF 2022 Sambhaji Sarjerao Doke ..Petitioner
Versus
Vijay Sarjerao Doke and Ors.
..Respondents Ms. Komal M. Mestry a/w Shyamsundar Solanke i/by PNP & Associates, for the Petitioner.
Mr. Santaram Tarale, for the Respondent Nos.1 to 3. CORAM : NITIN W. SAMBRE, J.
DATE : 5th APRIL, 2022 P.C.
1.
In view of order dated 16th February, 2022 passed in Writ Petition No.9738 of 2021, I hardly see any reason which warrants interference in the order impugned passed on 21st March, 2022 below Exh.32, particularly, when the petitioner/defendant is the joint owner of the property.
2.
Apart from above, it can be noticed that the petitioner has not offered or suggested particular path passing from the boundary of his land or otherwise, so as to provide approach to the respondents as was directed.
3.
That being so, no case for interference in the order impugned is made out.
4.
The petition as such fails, dismissed.
