This is an application seeking to continue to prosecute Criminal Appeal No. 766 of 2005. The Appellant in Criminal Appeal No. 766 of 2005 has expired on 16.11.2018 as per the Birth and Death Register issued by the Gramsevak of Village Hebbal Jaldhyal, Tal Gadhinglaj, Dist. Kolhapur. The proposed Appellant Surekha happens to be the wife of the Appellant. Whereas proposed Appellant Nos. 2 and 3 are the minor children of deceased Ranjeet Vishnu Patil.

Taking into consideration the fact that the Original Appellant has challenged the conviction for the offence punishable under Section 7, 12 and 13(1) (d) r/w. Section 13(2) of the Prevention of
