The Applicants seek condonation of delay of 220 days in preferring the First Appeals against the judgment and award dated 6th June 2006 passed by the Civil Judge, Senior Division, Barshi, Solapur in LAR Nos.702 of 2002 and 706 of 2002 respectively. The Respondents No.1(1) and 1(3) in First Appeal (Stamp) No.9536 of 2007 are served through Court notice. However, the notice issued to Respondents No.1(2) and 1(4) was returned with the bailiff's remark 'died'. The Applicants/Appellants were to take steps in respect of Respondents No.1(2) and 1(4). Appellants/Applicants were to take steps in respect of Respondents No.1(2) and 1(4). It appears that the Appellants/Applicants have not taken any steps in respect of notice to the said Respondents.

In the First Appeal (Stamp) No.9540 of 2007, none appeared. The sole Respondent has been served.

Today when the matter is called out, none appears for the Applicants/Appellants in both the Appeals. It appears that the Applicants/Appellants are not interested in prosecuting the Appeals.

Appeals are thus dismissed.
