Respondent No. 6 tendered a copy of letter dated 23rd January 2023 and 1st February 2023 which are collectively taken on record and marked 'X' for identification. In view of this letter, Mr. Kadam states that prayer clauses (a) and (b) are worked out which leaves prayer clause (c).

Mr. Patel states that he has personally spoken to

2/2 908.4779.22 wps.doc Respondents Nos. 2 & 3 and Under Secretary, Forest Department and states that complete process of transfer lease of the project site in favour of Petitioner will be completed within 8 weeks from today. Same is accepted as an undertaking to this Court. Mr. Patel states that this is subject to Petitioner paying the transfer charges and complying with other terms and conditions for transfer of the lease. Mr. Patel relies on the letter dated 3rd February 2023 that he has received from Under Secretary, Forest Department of Maharashtra State. It is taken on record and marked 'X1' for identification.

In view of above, nothing would survive in the petition. Petition disposed.
