The Applicant, apprehending arrest, in connection with the investigation of Crime No.66 of 2022, registered with Akkalkot South Police Station, under Section 306, 511, 504 and 506 read with Section 34 of Indian Penal Code and 39 and 35 of Maharashtra Money Lending (Regulations) Act, 2014, is seeking anticipatory bail.

Heard learned counsel for the parties.

The only allegation against the Applicant is that he has signed as a witness on the Sale Deed executed by the informant in favour of the wife of the Accused No.1. The Accused No.1 was arrested and has been released on bail. N.S. Kamble page 1 of 3

The investigation is complete and the charge-sheet is filed.

The learned counsel for the Applicant pointed out that the informant/victim had consumed poison. However fortunately he has survived and therefore there is no offence which can be said to be committed under Section 306 or even abetment thereof.

The learned Additional Public Prosecutor submitted that the Applicant may be directed to join the investigation. 7.
In such circumstances, the following order is passed.
ORDER
(i) In the event of his arrest in connection with investigation of Crime No.66 of 2022, registered with Akkalkot South Police Station, the applicantSiddhaling Basvanppa Patil shall be released on bail on executing a P.R. Bond in the sum of Rs.25,000/- with one or two solvent sureties in the like amount. (ii) The applicant shall report to the Investigating Officer on 6 and 7 April 2022 between 11.00 am to 1.00 p.m. and as and when called by the investigating N.S. Kamble page 2 of 3
officer and shall co-operate with the Investigating Agency.
(iii) The applicant shall not tamper with the prosecution evidence/witnesses.
(iv) The Criminal Application is disposed of in the aforesaid terms.
