By this application the applicant is seeking transfer of Marriage Petition No. 11 of 2024 filed by the respondent which is pending before the Family Court, Satara to Civil Judge Senior Division, Hingoli.

It is the contention of learned counsel for the applicant that applicant stays at Hingoli with her parents. She has no source of income. The distance between Hingoli to Satara is more than 500 km. The applicant is finding difficult to attend the Court dates at Satara. Learned counsel for the applicant 1/3

further submits that the applicant had filed DV proceeding against the respondent and it is pending before the Judicial Magistrate, Fist Class, Hingoli. The respondent is attending Coutt dates in the said proceeding. Hence, requested to allow the application.

Though the respondent is served, none present for the respondent. Hence, I am deciding this matter on merit. 4.

The applicant stays at Hingoli with her two sons. She is a lady. She has no source of income. The distance between Hingoli to Satara where the Divorce Petition filed by the respondent is pending, is more than 500 km. She finding difficult to attend the Court dates at Satara. Moreover the respondent is attending Court dates at Hingoli in the DV proceeding filed by the applicant. It is settled principle of law that convenience of the wife has to be considered over the husband's. Considering these facts, I pass the following order.

O R D E R

I.

Application is allowed.

Marriage Petition No.11 of 2024 pending before the Family Court, Satara to be transferred to Civil Judge, Senior Division, Hingoli.

III.

Both parties to appear before the Civil Judge, Senior Division, Hingoli.
