Heard learned counsel for the parties. Appeal is admitted by separate order today.

This application is filed by husband/father for stay of the impugned order under which custody of the minor child is directed to be given to Respondent/wife, which is already so given to the Respondent. It is pointed by the learned counsel for the Applicant that though access is already provided under the impugned order 'at the residence of wife', it has not worked so far. 3.

It is seen from the record that this Court had attempted to arrive at interim arrangement and dispute was referred to mediation on 25.04.2023. But neither the interim arrangement has worked nor the mediation.

In these facts and circumstances, this application is disposed of Husen

8(2) IA-3960-2023.doc with liberty to the Applicant/husband/father to take out fresh appropriate application, seeking interim access to the child in the changed circumstances.
