Heard learned Counsel for the parties.
This Review Petition preferred by respondent wife to Review the order dated 07.02.2014 passed by this Court (Coram : Smt. Vasanti A. Naik J) in Second Appeal no. 62 of 2014 with Civil Application no. 1699 of 2013.
The learned Counsel for the petitioner submits that the order passed by the Trial Court directed respondent husband to pay maintenance charges @ Rs. 4000/ per month to the wife petitioner. Till today, the respondent husband has not clear the arrears. The arrears is more than Rs.1,50,000/. Hence, he preferred present Review Petition to attach the respondent's/husband's property for Sneha Chavan 1/2
3 RPS 1414.doc securing the arrears of maintenance.
The learned Counsel for the respondent husband after taking instructions from his client, who is present in this Court makes a statement that respondent is ready and willing to clear the entire maintenance charges within two months from today. To that effect, he has filed affidavitcumundertaking dated 15.10.2015. Same is taken on record. The undertaking given by the respondent Mr.Bhagwat Namdeo Lande in paragraph 2 is accepted.
The learned Counsel for the petitioner submits that in view of subsequent development that respondent husband is ready and willing to pay arrears of maintenance charges within two months from today, they do not want to press the present Review Petition. She seeks liberty to withdraw the same. Same is allowed.
Review Petition stands dismissed as withdrawn.
