Heard learned counsel for applicant and learned APP. Investigating Officer is present. Perused case diary. 2.

Applicant is granted interim protection observing that complainant is major aged 25 years old and in fact, it is found that complainant herself initiated contact with applicant by sending him text message to which applicant replied. It was further noted that there was delay in lodging FIR and thus by protecting applicant by interim order, he was directed to attend Investigating Officer. 3.

Learned APP, on instructions, makes a statement that applicant has attended Investigating Officer as directed and his mobile

ppn 2 10.aba-704.19.doc phone is also seized for the purpose of investigation. It is therefore, found that though investigation is in progress, custodial interrogation of applicant is not necessary. Hence following order is passed :-

ORDER

(i) Interim order dated 20th March 2019 stands confirmed with further direction to applicant to attend Investigating Officer if called till filing of charge-sheet;
