Heard the learned counsel for the applicant and learned counsel Mr. Patil for respondent no.2. On perusal of the application, it is evident that the applicant was informed that the proposal has been forwarded to the Law and Judiciary department by the Additional Public Prosecutor but the same being rejected and this left him with no other option then to present the appeal himself. Finding the cause for the delay in filing the appeal to be justified one and bonafide, I deem it appropriate to condone the Ashish
