Mr.Koregave, learned counsel for the petitioner submits that the issue of tenancy was already decided by the Competent Court by order dated February 16, 2000. He however submits that this order could not be brought to the notice of the trial Judge at the stage of when the impugned order was made.

Without going into the merits of the matter, since, new contention is raised, leave is granted to file a review petition. Such review petition if filed, is to be considered and disposed of on its own merits and in accordance with law.

With the aforesaid liberty, this petition is disposed of. 4.

There shall be no orders as to costs.
