The learned counsel appearing for the Executive Engineer Minor Irrigation Department, Sangli seeks to withdraw the First Appeal on the ground that the parties have arrived at an amicable settlement. 2.

The learned counsel for the Respondent No.1 submits that the Respondent No.1 is present in the Court and is identified by the learned counsel.

As per the amicable settlement between the parties, the decree holder has agreed to accept an amount of Rs.5,84,554/- with accrued interest thereupon till the date of withdrawal. It is also agreed that the Appellant is entitled to receive the remainder of Rs.4,21,561/- without any interest out of the amount which was already deposited in the Reference Court i.e. Rs.10,06,115/-.

In view of the Consent Terms filed on record, the First Appeal stands disposed of with no order as to costs. 6.

Court fees be refunded as per rules.
