The application is moved for pre arrest bail. Today the police constable is sent by the investigating officer. Investigating officer is not present though directed by this Court and the injury certificate is also not sent along with him. Therefore the matter is taken.

The applicant is facing charges for the offences punishable under Sections 307, 323, 504 and 506 read with 34 of the Indian Penal Code in C.R. No. 140 of 2015 registered with Kurduwadi police 1 / 2

901-aba-496-2015.doc station, Solapur. It is the case of the prosecution that the complainant Rajendra Arnale was assaulted by the applicant/accused and co­ accused on 7th September, 2014. He got injuries as incised wounds and other contusion wounds.

The learned counsel for the applicant/accused has submitted that applicant/accused is not the one who has assaulted the complainant with sickle. After going through the medical certificate of the private hospital, it appears that the injuries were on the wrist and finger of the complainant but these are contusion wounds. Considering the role attributed to the applicant/accused, I am inclined to confirm the pre arrest bail granted earlier by this Court by an order dated 8th April, 2015. Now the applicant shall attend the concerned police station till filing of the charge­sheet. 4.

The anticipatory bail application stands disposed of in these terms.
