The Applicant, apprehending arrest, in connection with the investigation of Crime No.78 of 2022 registered with Rajapur Police Station, under Section 353, 332, 143, 147, 149, 504 and 506 of Indian Penal Code, is seeking anticipatory bail. 2.

Upon hearing the learned counsel for the parties for sometime, I find that the Application can be disposed of on a short count as none of the offences, which are invoked against the Applicant, invite a sentence in excess of 7 years of imprisonment. 3.

In such circumstances, the learned APP on instructions, from the Investigating Officer, states that the Investigating Officer shall issue notice to the Applicant under N.S. Kamble page 1 of 2

913-aba-942-2022.odt Section 41A of Cr.P.C., in the event the Investigating Officer is desirous of effecting arrest of the Applicant. The statement so made is accepted.

In view of the specific statement the Criminal Application is disposed of with liberty to the Applicant to renew the request for anticipatory bail, in the event of receipt of the notice under section 41A of Cr.P.C. The Investigating Officer shall issue, such notice of three clear working days, if he desires to arrest the Applicant.
