Civil Application 4367 of 2013 is filed for condonation of delay of 292 days in preferring the appeal, which is filed for enhancement of compensation granted by the Tribunal.

The learned Counsel appearing for the applicants submits that due to financial problems, they could not meet the legal expenses and hence, could not file the appeal in time. It is submitted that the applicants have a good case on the point of enhancement and therefore pray that the delay be condoned.

Heard the learned counsel for the respondents / KSRTC. 4.
In view of the submissions of the learned Counsel for the applicants and for the reasons stated in the Civil Application No.4367 of 2013, the delay is condoned. Civil Application is allowed. Appeal be registered. 5.
First Appeal No.1837 of 2013 is a cross appeal. 6.
In view of the above, both the Appeals are admitted. 7.
The appellant/KSRTC to file paperbook within one year from today. If the same is not filed, the First Appeal 1837 of 2013 shall stand dismissed without reference to the Court.
