The effort of petitioner informant is to prima facie demonstrate that the investigation is not undertaken promptly on proper lines. 2.

Learned APP however submits that investigation is long over and summary was also sent for approval to the office of SDO. He states that lacunae in investigation therefore can be demonstrated in the court where that summary is to be filed.

We find from the communication produced by the learned APP that the alleged incident is of April 2016 and communication by investigating officer on above lines is dated 11/12/2017. It appears that summary was also approved by SDO on 31/3/2017. We in this situation direct respondent to submit that summary to the Trial Court within 4 weeks from today with previous intimation to the petitioner. It is open to the petitioner to lodge protest thereafter. The trial Court shall deal with the controversy in accordance with law at the earliest.
