2) Present Application seeking condonation of 297 days delay in filing the aforesaid Appeal.
3) Respondent Nos.1 and 2 have been duly served through publication. However, none present for the Respondent Nos.1 and 2. 4) Mr. Misar, learned Advocate for the Respondent No.3 opposed the Application.
5) Mr. Mendon, the learned Advocate for the Applicant submitted that, the Applicant has sustained 60% permanent partial functional disability on account of the accidental injuries. As a result, the Appellant is unable to walk and do his day-to-day activities. Therefore, the Applicant could not promptly contact his Advocate. Besides, the Applicant was facing 1/2
Manoj 23-CAF-3373-2016.doc financial difficulties. Therefore, the Applicant could not file the Appeal on time. The Applicant has good case on merits.
6) Considering the aforesaid submissions by learned Advocate Mr. Mendon, and other grounds stated in the Application, the Application deserves to be allowed. Hence, following Order.
ORDER
(a) Application is allowed.
(b) Delay of 297 days in filing the aforesaid Appeal is condoned. (c) Appeal be registered forthwith.
(d) Application stands disposed of.
