This interim application is filed by the original applicants-accused for modifying the order dated 08.01.2024 to permit them to make the balance payment as noted in the order within a reasonable short future date.

Learned counsel for the applicants invited my attention to the said order dated 08.01.2024. It is recorded in the order that the applicant were seeking anticipatory bail in connection with Digitally signed by VINOD BHASKAR GOKHALE Date:

C.R.No.266 of 2023 registered at Sawantwadi police station. The gist of the F.I.R. is that the applicant had taken Rs.11 lakhs under a scheme and it was misappropriated. On the last occasion, learned counsel for the applicants had made submissions that the applicants would deposit Rs.15 lakhs. Out of which, Rs.5 lakhs were already deposited. The balance amount is Rs.10 lakhs. Today, learned counsel states that, Rs.2 lakhs are given through a cheque in the Court. Learned counsel for the intervenor accepts this fact. Learned counsel for the applicants states that, said cheque will be honoured and if it is dishonoured, the ad-interim relief can be vacated.

Learned counsel for the applicants further submitted that the amount of Rs.4 lakhs would be paid to the informant on or before 25.04.2024 and the balance amount of Rs.4 lakhs would be paid on or before 10.06.2024.

Considering his willingness to pay this amount, time to pay the said amount can be extended.

Hence, the following order :

O R D E R

1. The Applicants are permitted to make the payment as per the schedule mentioned herein above.

2. The ad-interim relief granted in the A.B.A.No.3604 of 2023 is extended till 12.06.2024.

3. The Interim Application No.1164 of 2024 is disposed of.

4. The A.B.A.No.3604 of 2023 be listed on 12.06.2024. (SARANG V. KOTWAL, J.)
